ISHRAT-UN-NISA VS SAEEDA BEGUM West Pakistan Urban Rent Restriction Ordinance 1959--13 , S. 13 (2) (ii) (a) - Subletting-eviction-Respondents-landlord accepting -appellant (issueless widow of original tenant) as tenant of shop after death of husband but later seeking eviction of appellant on ground of sub-letting of shop to real younger brother of appellant's husband-Courts below completely ignoring close relationship between appellant and younger brother of appellant's husband (respondent) and his looking after his elder brother's childless widow and her affairs-Appellant's inability to look after business not disputed -Respondent brother of appellant's husband being heir of deceased tenant, being entitled to succeed to his assets, management of business of deceased by him, held, neither unusual nor unnatural and contradictions in appellant's evidence, being of very minor nature not sufficient to conclude subletting of shop.
