RASHIDA BEGUM VS MUHAMMAD MOBIN West Pakistan Urban Rent Restriction Ordinance 1959--13 , S. 13-eviction proceedings--Rent Controller finding tenant not paying rent in advance as provided in agreement between parties, ordering eviction on ground of default-First Appellate Court not agreeing 'with finding of Rent Controller holding that lease agreement executed between parties being inadmissible in evidence as not properly stamped cannot be looked into for any purpose and in absence of an agreement providing for payment of rent by specified date, tenant can pay rent within 60 days of its becoming due-Rent application specifically laying down that's monthly rent is payable in advance as per agreement and this was admitted by tenant and as such rent of premises should have been paid or tendered by tenant before 15th of each month-Tenant, held, defaulter and his eviction by Rent Controller, rightly recorded, in circumstances.
