PROVINCE OF PUNJAB VS CIVIL JUDGE, LAHORE West Pakistan Urban Rent Restriction Ordinance 1959--13 , ------S. 13 - Default in payment of rent - eviction - Government, privilege of-Contended on behalf of Government lessee that according to Departmental practice a bill has to be prepared and presented for passing to Audit office and Audit office insists on a certificate from Excise & Taxation Department showing assessed annual rental value of premises but respondent landlord having failed to supply a copy of such certificate petitioner paid rent @ 50 % p. m. for about 9 months and still finding certificate in question having not been supplied withhold payment of rent in accordance with usual practice-Held: Nothing in S. 13 of Ordinance VI of 1959 makes any distinction between a private tenant and a Government Department-Government Departments required to pay rent to landlord like any other private tenant and equally liable to ejectment on default in payment of rent-Nor open to Government Department to take premises on lease and impose conditions of its own choice on landlord-eviction of petitioner justifiably
