MUHAMMAD UMAR VS MUHAMMAD YOUSAF Displaced Persons (Compensation and Rehabilitation) Act 1958--30 , -- S. 13 read with Displaced Persons (Compensation and Rehabilitation) Act (XXVIII of 1958), S. 30-eviction of tenant-Landlord and tenant, relationship of-Proviso (b) to subsection (1) of S. 30 only places embargo upon right of landlord transferee to eject tenant for 6 years counted from date of notice under S. 30-Relationship of landlord and tenant however comes to be regulated in accordance with general law relating to such relationship i.e., Ordinance VI of 1959, on expiry of period mentioned in proviso (b) to subsection (1) of S. 30 or on contravention of any of provisions of subsection (3) of S. 30 whichever earlier-Tender of rent not directly made to landlord after expiry of 30 days period counted from date of notice of demand-No tender in eye of law, hence, held, constitutes default in payment.
