BASHIR AHMAD VS MUHAMMAD HANIF AND ANOTHER West Pakistan Urban Rent Restriction Ordinance 1959--13 , West Pakistan Urban Rent Restriction Ordinance 1959--15 , West Pakistan Urban Rent Restriction Ordinance 1959 ---- S. 13(3)(ii)(c) read with S. 15--eviction on ground of requirement for landlord's own use-Tenant not raising plea that landlord had in his occupation other shops as well-Landlord, on other hand, stating that he had no shops from which inferential conclusion could be drawn that he had not also vacated any shop-Inferential conclusion, in a proper case, can satisfy requirement of S. 13(3)(ii)(c)District Judge misreading evidence, drawing conclusions against it and without giving good reasons differing from opinion of Rent Controller-Order of District judge set aside and that of Rent Controller restored.
