SONA MIA VS THE SUB-DIVISIONAL OFFICER, NARAYANGANJ AND 2 OTHERS Ejectment--TERM , Ejectment S. 2(1) & (2)-Ejectment-Magistrate under subsection (1) can summarily evict those persons only who trespass into someone's land who had to leave same on account of, or in apprehension of, civil disturbances of January 1964-Order of eviction not mentioning such facts and without local inquiry held, without lawful authority-Order restoring possession also held, without lawful authority in circumstances.
