JAMEEL-UR-REHMAN VS MASOOD HUSSIAN ANTRIA Ss. 15 & 21 (3)---eviction of tenant---Default in payment of rent---Scope---Contentions of tenant were that landlord refused to receive rent which was sent through money order thereafter, and that application for calling postman was also submitted before the Appellate Court---Validity---Both the courts below had given findings with regard to sending of money order to the landlord---Postman who delivered the money order stated that no record of the same was available---Exercise for calling the postman could not be undertaken at appellate stage when tenant had already denied such opportunity at trial---High Court having limited constitutional jurisdiction in such matters, constitutional petition was dismissed with costs.
