IMRAN QADIR VS ROQIYA SULTANA Cantonments Rent Restriction Act 1963--17 , Eviction petition--Term , S. 17---eviction petition---Ailment of tenant---Tenant assailed eviction order for being unheard on reason of ailment after appearance---After first appearance of tenant, it took more than four months to finally decide the case---For such a long period, tenant did not pay any attention to legal proceedings against him for which he was well aware that same might culminate into his ejectment from premises---Even if tenant was suffering from some ailment, the same was not so severe to hinder his appearance before Rent Tribunal for such a long duration---Tenant remained non-serious during the proceedings and also filed an appeal with delay on ground of alleged ailment which was not reasonable ground for such conduct---Appeal was dismissed accordingly.
