NOREEN GUL VS GOVERNMENT OF KHYBER PAKHTUNKHWA through Secretary Elementary and Secondary Education Department), Peshawar S.3---appointment of primary school teachers---Scope---Petitioner applied for the post of primary school teacher but the department did not appoint her on the ground that she was permanent resident of another district then the one for which the posts were advertised---Validity---Section 3 of the Khyber Pakhtunkhwa (appointment, Deputation, Posting and Transfer of Teachers, Lecturers, Instructors and Doctors) Regulatory act, 2011, insisted upon consideration of the permanent residence of a candidate on the basis of his Computerized National Identity Card (CNIC) as well as his domicile---Computerized National Identity Card of the petitioner showed that she was the resident of another district than the one for which posts were advertised---Constitutional petition was dismissed.
