NUSRAT JAN VS State Ss. 302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Sentence, reduction in---Mitigating circumstances--- Scope---Accused was charged that she with the abetment of co-accused by administering poison, caused the murder of her husband/brother of complainant---In the present case, the delay in lodging FIR had properly been explained and keeping in view the circumstances of the case, it could not be said that the prosecution had consumed time for concocting any case against the accused or the co-accused, however, said factor could be counted towards the quantum of punishment---Moreover, there were certain mitigating circumstances which had persuaded to reduce the sentence awarded to the accused, thus, after considering the entire evidence and circumstances of the case, while maintaining the conviction, High Court reduced the sentence awarded to the accused by the Trial Court to the sentence already undergone---Appeal was disposed of accordingly.
