SHAHZADA AMAN ROOM VS MIANGUL HILAL O.XVII, R.3---Court may proceed notwithstanding either party fails to produce evidence---Scope---If the orders passed under O.XVII, R.3, C.P.C., are liberally set aside then there would be no discipline in the adjudication of civil litigations and the delinquent litigant whose case was though squarely hit and covered by the penal provisions of O.XVII, R.3, C.P.C., would be given a chance to his advantage and to the disadvantage of his opposing side---Such an approach is not according to the spirit of law.
