YAR MUHAMMAD VS Moulvi ABDUL FATAH S.373---Succession---Jurisdiction of Civil Court---Procedure under S.373 of Succession act, 1925 was summary in nature, it could not conclude the right of the parties---If a party desired for determination of his right the remedy would lie in suit before a court of competent jurisdiction---For determination of title, the same could be decided by the civil court of competent jurisdiction by way of filing civil suit for the purpose to establish the claim and recovery of share.
