MUNAWAR ALI VS UMAR DARAZ O.I, R.10---No proceedings in court could be ipso facto defeated just because of non-joinder/misjoinder of partiers and the court would always enjoy ample powers to add/delete/transpose parties to suit depending upon the nature of the case---Plaintiffs had to be provided opportunity to correct the technical defect and not to dismiss/reject the plaint on technical ground.
