VS S. 3---abuse of dominant position---Scope---When a dominant under taking owns and/or controls and/or itself uses and/or has the ability to grant the right to use an essential facility i.e. the facility or the infrastructure without access to which other undertakings cannot provide competing services to the end consumers, refuses competitors to access such facility or grants access to competitors only on terms less favourable than those which it gives to others, it places the competing undertakings at a disadvantage; these are considered exclusionary practices that are specifically prohibited under S. 3 read with subsection (3) clauses (e) and (h) of the Competition act, 2010.
