MIRPURKHAS SUGAR MILLS LIMITED VS FEDERATION OF PAKISTAN through Secretary Ministry of Law and Justice Presumption---applicability---Presumption always leans in favour of Constitutionality and legality of a statute---Where two opinions are possible, one, favouring validity of law has to be adopted---Such presumption is considered rebuttable and prone to discard and disgorge when the person challenging the law succeeds in establishing discrimination among the persons or objects who are similarly placed; particulars of discrimination; arbitrariness and irrationality in classification or selection of the person or goods or activity; or is able to show that the law is violative of any of the fundamental rights or provisions of the Constitution.
