VS S. 62 & Chap. II [Ss. 3 to 11]---Validation of actions---Prohibition of abuse of dominant position, certain agreements and deceptive marketing practices---Retrospective effect---Scope ---Section 62 clarifies that any such matter, action or conduct which distorts the state of competition in Pakistan on the 2nd October, 2007, or subsequent to the foregoing date shall be cognizable by the Commission---No denying the fact that concluded transactions taking place prior to the 2nd October, 2007 are not cognizable by the Commission, but matters which distort competition and are valid or continue post that date fall within the regulatory prowess of the Commission---Date of execution of any matter or any action is of no concern during the course of proceedings for the purpose of ensuring competition under the Act, if the same matter or action has resulted in distortion of competition after the enforcement of the Act.
