ASHIQUE ALI VS State Ss. 302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Ocular account was in line with the medical evidence---Accused were charged for committing murder of the father of complainant by firing---Defence objected that there were general allegations against the accused of firing upon the deceased and it had not been established beyond doubt as to by whose fire shot the deceased had been killed therefore the accused were liable to be acquitted---Said plea of defence had no force as all the witnesses deposed that all the accused actively participated in the commission of offence and they fired from their weapons upon the deceased which hit the deceased---Evidence of witnesses was corroborated by medical evidence including the recovery of crime empties from place of vardat and pistol from the accused after few hours of the incident with positive Forensic Science Laboratory Report---Circumstances established that the prosecution had proved its case against the accused beyond a reasonable doubt---Appeal against conviction was dismissed accordingly.
