MUHAMMAD YAR VS State Ss. 302, 324 & 34---Qatl-i-amd, attempt to commit qatl-i-amd, common intention---Appreciation of evidence---Benefit of doubt---Delay of two hours and forty five minutes in lodging the FIR---Scope---Accused were charged for committing murder of the wife of complainant and injuring the complainant by firing, who died later---Motive behind the occurrence was a dispute over land between the parties---Record showed that the occurrence in the case took place at 05:30 p.m. near a ground and the matter was reported to the police at 08:15 p.m.---Distance between police station and the place of occurrence was eleven kilometres---Two hours and forty-five minutes delay took place in reporting the crime to the police without there being any plausible explanation---Two witnesses while appearing before the Trial Court to furnish ocular account did not utter even a single word about the said delay---Said delay in setting the machinery of law into motion spoke volumes against the veracity of prosecution version--- Circumstances established that the prosecution had failed to prove its case against the accused beyond the shadow of doubt---Appeal against conviction was allowed, in circumstances.
