AMJAD SAEED VS MUHAMMAD SAEED S. 15----acquisition by prescription---Conditions precedents---Following conditions must be fulfilled for acquisition of a right of easement by prescription; i.e. the right claimed must not be uncertain; the right claimed must have been enjoyed; and it must have been enjoyed (i) peaceably, (ii) openly, (iii) as of right, (iv) as an easement, (v) for twenty years or sixty years, if the right is claimed against government---Out of the last six sub-conditions, (ii) and (iii) are not necessary in the case of easement of the light and air or support---With this exception, all the conditions and sub-conditions must be fulfilled before the right of easement is acquired.
