JIND WADA VS ADDITIONAL DISTRICT JUDGE O. XXIII, R. 1---Expression "on such terms as it thinks fit" means an order after affording opportunity of hearing to the other party which is going to be effected by such permission of withdrawal of the suit---Accordingly the permission shall be contingent on such terms as the Court thinks fit as a natural corollary.
