ASMATULLAH PATHAN VS State S. 9(c)---Possession of narcotics---Appreciation of evidence---Benefit of doubt---Contradictions in statements of witnesses---Scope---Prosecution case was that twenty kilograms of charas was recovered from the secret cavities of the vehicle driven by the accused---Record showed that the complainant in his evidence stated that the narcotic was recovered from the car by a police witness whilst said police witness stated that the narcotic was recovered from the car by the complainant---Police witness initially stated that the narcotic was found in the back seat of the car and was recovered by using a screw driver and later in cross-examination stated that the narcotic was hidden in the petrol tank---Complainant stated that the secret cavity was accessed by using a hammer and not screw driver---Circumstances established that the prosecution had not proved its case against the accused beyond a reasonable doubt---Appeal against conviction was allowed, in circumstances.
