Mir AHMED VS State Ss. 302 & 109---Qatl-i-amd, abetment---Appreciation of evidence---Accused was charged for committing murder of the brother of the complainant by firing---In the present case, the nomination of the accused was made immediately after the incident---Statements of the eye-witnesses remained unshaken---No possibility existed of wrong nomination or identification of the accused as he alone was saddled with attribution of killing the deceased---No justification was provided by the complainant party to replace the actual murderer with the accused---Medico-Legal Certificate of deceased completely supported the ocular account of the witnesses---All the said factors were sufficient to conclude that the prosecution successfully brought home the charge against the accused beyond any shadow of doubt---Appeal against conviction was dismissed, in circumstances.
