Rao Humayun Waqas VS State Ss. 302(b), 109 & 34---Qatl-i-amd, abetment, common intention---Appreciation of evidence---Absconsion of accused---Inconsequential---Accused was charged that he along with co-accused in furtherance of common intention committed murder of the son of complainant by firing---Record showed that accused remained absconder---However, mere abscondence of accused was not a conclusive proof of the guilt of the accused---Value of abscondence depended upon the fact of each case and abscondence alone cannot take the place of guilt unless and until the case is otherwise proved on the basis of cogent and reliable evidence---Circumstances established that prosecution had not been able to establish the charge against the accused beyond any shadow of doubt---Appeal against conviction was accordingly allowed.
