AMMAR BASHIR VS IRFAN SHAFI KHOKHAR (Returned Candidate) Ss. 142, 143, 144(4) & 145(1)---Election petition---Maintainability---Non-fulfilment of mandatory requirements while filing the election petition---Consequences and effect---Tribunal bound to reject petition at the outset---The requirements given in Ss. 142 to 144 of the Elections Act, 2017 for presentation of election petition, impleading parties to such petition and contents of the election petition to challenge election in any constituency are followed by S. 145(1) of the Act, 2017 which requires rejection of election petition if aforesaid provisions were not complied with, moreover, the Tribunal cannot wait till the culmination of the proceedings through regular trial and it is mandate of law to reject the plaint.
