CM PAK LIMITED VS The PAKISTAN TELECOMMUNICATION AUTHORITY Ss. 23(1) & 33a(4)(b)---Payment of Universal Service Fund (USF)---Delay---Demand of payment of Late Payment additional Fee (LPaF)---Plea of pendency of suit for recovery---Validity---If at all the appellant was able to secure a decree in its favour, it could surely institute execution proceedings against the defendants in the said suit, but a claim simpliciter against the USF Company could not furnish a valid ground for the appellant to avoid its obligation under clause 4.1.2.2 of the licence to make its USF contribution.
