Changaiz Khan VS State Ss. 302(b), 324, 147, 148 & 149---Qatl-i-amd, attempt to commit qatl-i-amd, rioting, rioting armed with deadly weapons, unlawful assembly---Appreciation of evidence---Delay of one hour and 40 minutes in lodging the FIR---Consequential---Accused were charged for committing murder of two sons of complainant and also causing firearm injuries to his two other sons---As per contents of FIR, the alleged incident occurred at about 02:10 p.m., whereas, the present case was registered at about 04:10 p.m. despite the fact that the Police Station was only three kilometers away from the place of occurrence--- Delay of one hour and forty minutes in reporting the matter to the police adversely affected the veracity of complainant---Circumstances established that the prosecution had failed to prove its case against the appellants---Appeal against conviction was allowed accordingly.
