Abdul Hameed Shah VS State Ss. 302(b), 324 & 34---Qatl-i-amd, attempt to commit qatl-i-amd, common intention---Appreciation of evidence---Delay of three days in lodging the FIR---Not fatal to prosecution case---Accused was charged that he with rest of the culprits, in furtherance of their common intention, not only caused fire shot injuries to the sons of complainant but also caused danda blow to complainant with intention to commit their murder; and one son of the complainant died because of his injuries---Delay in lodgment of the FIR was well explained by the complainant by stating that the elders of the community prevented him from lodging the same to have a private faisla (arbitration) which they failed to have on account of death of the deceased, therefore, such delay in lodgment of the FIR could hardly be treated to be fatal to the case of prosecution---Appeal against conviction was dismissed, in circumstances.
