Haq Nawaz VS State Ss. 302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Recovery of pistol on the pointation of accused---Inconsequential---Accused were charged for committing murder of the son of complainant by firing---Record showed that a pistol was recovered on the pointation of accused---Report of Forensic Science Agency was only regarding mechanical operating condition of the pistol and the empties recovered from the spot did not match with the said pistol, therefore, the recovery of pistol, at the pointing out of the appellant was of no avail to the prosecution---Circumstances established that the prosecution failed to prove its case to the extent of appellant beyond the shadow of doubt---Appeal against conviction was accordingly allowed.
