Attaullah VS State Ss. 302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Motive not proved---Accused was charged for committing murder of the father of complainant by firing---Record showed that a quarrel between the parties, two months prior to the incident had been alleged as motive---However, there was no evidence to show that the matter was reported to the police---Therefore, it could safely be concluded that prosecution was not able to prove the motive part of the story---Prosecution is not bound to setup motive in each and every case but once, it is alleged and not proved, then the ocular account is required to be scrutinized with due care and caution---In such circumstances, the prosecution must suffer consequences and not the defence---Appeal against conviction was allowed, in circumstances.
