KHURSHID ALI VS MIANGUL ADNAN AURANGZEB (deceased) Ss. 8, 42 & 54---Relief of possession with or without declaration of title---Principle---If plaintiff is in possession but his title to property is disputed or clouded, or if defendant claims title and poses a threat of dispossession, plaintiff must sue for declaration of title and seek injunctive relief---If plaintiff's title is clouded or disputed and he is not in possession or not able to establish possession, he must file suit for a declaration, possession and injunction.
