Asad Abbas alias Achoo VS State Ss. 302(b), 324, 109, 148 & 149---Qatl-i-amd, attempt to commit qatl-i-amd, abetment, rioting armed with deadly weapons, unlawful assembly---Appreciation of evidence---Benefit of doubt---Recovery of weapon of offence at the instance of accused---Inconsequential---Accused were charged for committing murder of two persons and causing injuries to a female of complainant party by firing---Record showed that a .30-bore pistol was recovered at the instance of the appellant---However, in the absence of any crime empties recovered from the place of occurrence, that recovery became wholly inconsequential and failed to advance the prosecution case---Circumstances established that the prosecution had miserably failed to prove its case against the appellate beyond the shadow of reasonable doubt---Appeal against conviction was allowed, accordingly.
