SHAHID ALI VS STATE. Art. 37---Criminal Procedure Code (V of 1898), S. 164---Expressions "confession" and "admission"---Scope---Expression 'confession' has not been defined in Qanun-e-Shahadat, 1984 nor in Criminal Procedure Code, 1898---Accused may make a statement in the nature of an 'admission' or a 'confession' and there is a distinction between these two expressions---Confession refers to a statement made by a person accepting or acknowledging his or her guilt relating to commission of crime or an offence---Acknowledgment of guilt must be with reference to charge against accused---Confession is divided into two broad categories i.e. judicial confession and extra judicial confession; the former refers to a confession made before and recorded by a Magistrate or a Court e.g. under S. 164, Cr.P.C. while extra judicial confession is an acknowledgment of guilt of commission of a crime made before any person other than a Magistrate under S. 164, Cr.P.C. or Court---Confession can be made orally or in writing and depending on facts and circumstances of a particular case, through gestures or signs as well---Fundamental principle regarding admissibility and assessment of a confession, judicial or extra judicial, is that it ought to be genuine, voluntary and must have been made out of one's free will---Confession must have been given freely and without any coercion or influence in any form.
