FARRUKH SULTANA Ss. 419, 420, 467 & 471---Prevention of Corruption act (II of 1947), S.5(2)---Cheating by personation, cheating and dishonestly inducing delivery of property, forgery of valuable security, using as genuine a forged document, criminal misconduct---appreciation of evidence---appeal against acquittal---Failure of prosecution to prove use of alleged fake PTC certificate---allegations against accused/respondent were that she presented a fake Primary Teaching Course (PTC) certificate for obtaining increment---Prosecution failed to produce any evidence showing that accused/respondent applied for inclusion of said certificate in her service record---Investigating Officer admitted that no verification of the certificate was carried out---accused/respondent had not secured her employment on the basis of said certificate---Neither the alleged fake certificate nor any verification document proving its falsity was produced before the Court---Prosecution failed to establish that accused/respondent prepared or used the forged document for any benefit---Material omissions struck at the root of the case---acquittal recorded by the Trial Court was justified---appeal against acquittal was dismissed, in circumstances.
