ABBAS ALI VS COLLECTOR OF CUSTOMS art.199 & 24---Constitutional jurisdiction of High Court---Subsequent developments during pendency of writ petition---Protection of property rights---Whether High Court can consider subsequent actions of customs department during pendency of petition and enforce property rights accordingly?---Held: High Court, while exercising its constitutional jurisdiction, is competent to examine subsequent developments and actions taken by the respondents-department during the pendency of this writ petition---Petitioner's entitlement to the seized gold jewellery was protected under art.24 of the Constitution, which guarantees the right to property and prohibits deprivation thereof save in accordance with law---Once the petitioner's entitlement had attained finality up to the Supreme Court of Pakistan, any action of the respondents resulting in denial of restoration of the property, or its refined form through arbitrary valuation, amounted to deprivation of property in violation of the constitutional safeguards---Constitutional petition was allowed, and the respondents-department were directed to release the refined gold bar to the petitioner after receipt of the penalty amounting to Rs.100,000/- from the petitioner.
