GHULAM ABBAS VS MUHAMMAD IJAZ S.88---Civil Procedure Code (V of 1908), O.XL---attachment of property---Receiver, appointment of---Object, purpose and scope---Provisions under S.88, Cr.P.C. are not meant to be punitive in nature or to entail penal consequences as a means of punishing the accused---These provisions are to be utilized against an accused connected with a criminal case who is evading process of law---They are not meant to deprive or harass any other person or be used as a sword of Damocles against others---To ensure non-violation of rights of persons connected with the attached property, S.88(6), Cr.P.C. expressly refers to O.XL, C.P.C. and provides that the powers, duties and liabilities of a receiver appointed thereunder are the same as those specified in O.XL, C.P.C., so that due process of law is not contravened.
