ABDUL REHMAN FARYAD VS GOVERNMENT OF PUNJAB through Home Secretary Chapter XXIV, R. 5 [Inserted vide Notification No.14/EXEC-III, dated 02-01-2024]---Criminal Procedure Code (V of 1898), S. 249-A---Punjab Prohibition of Kite Flying Ordinance (LIX of 2001), Ss.3 & 4---Acquittal---Police Character Certificate---Petitioner was alleged to have violated Punjab Prohibition of Kite Flying Ordinance, 2001 but Trial Court acquitted him of the offence---Grievance of petitioner was that character certificate issued to him by police reflected registration of said criminal case in which he had been acquitted---Validity---Once a person has been acquitted and that order has attained finality, any act by public authorities that continues to associate such individual with that criminal allegation undermines not only the acquittal itself but also the foundational principles of fairness, dignity and presumption of innocence---Petitioner was entitled to a Police Character Certificate that would reflect his acquittal and absence of any subsisting criminal liability---High Court directed Punjab Government to ensure issuance of Police Character Certificate in favour of petitioner accurately reflecting his legal status---High Court further directed the authorities to exclude and omit any reference to the FIR in the light of lawful acquittal and absence of any existing criminal liability---Constitutional petition was allowed accordingly.
