DIRECTOR, DIRECTORATE OF INTELLIGENCE AND INVESTIGATION, CUSTOMS, MULTAN VS CUSTOMS APPELLATE TRIBUNAL S.196---Constitution of Pakistan, Art.10A---Ex-parte decision---Reply of authorities, non-seeking of---Principles of fair trial and due process--- Customs Authorities challenged judgment passed by Customs Appellate Tribunal on the ground that same was passed in their absence. Validity--- Authorities were not provided fair opportunity to be represented through counsel of their choice and to present their case. Passing of order without hearing the concerned authorities amounted to condemnation unheard. Such action was contrary to principles of due process and fair trial guaranteed under Article 10A of Constitution of Pakistan. High Court set aside judgment passed by Customs Appellate Tribunal. Matter was remanded to Tribunal for decision afresh after providing proper opportunity of hearing. Reference application was allowed accordingly.
