Mst. Fateh Khatoon VS Muhammad Qasim Ss. 302(b), 201, 342, 337-H(2), 506(2), 109, 148 & 149---Criminal Procedure Code (V of 1898), Ss. 435 & 439---Qatl-i-amd, causing disappearance of evidence of offence or giving false information to screen offenders, wrongful confinement, hurt by rash or negligent act, criminal intimidation, abetment, rioting armed with deadly weapons, unlawful assembly---Appreciation of evidence---Revision petition for enhancement of sentence----Scope---Accused were charged for committing murder of the nephew of the complainant by firing---Power to enhance a sentence was to be exercised sparingly and only in cases where there was a manifest miscarriage of justice---Such enhancement required the presence of clear, cogent and convincing evidence, elements that were conspicuously absent in the present case---In the instant matter, all important components were either lacking or insufficiently substantiated, thereby rendering any enhancement of sentence unjustified---Thus, in view of said facts, when there were no cogent reasons available in the prosecution case to justify the enhancement of sentence and the prosecution had also failed to demonstrate any compelling circumstances warranting enhancement of the punishment---Therefore, any attempt to seek enhancement of sentence in the given situation appeared to be unjustified and improper, therefore, did not call for the invocation of the revisional jurisdiction of this Court for enhancement of the sentence---Revision petition for enhancement of sentence was dismissed.
