Kamran Mirza VS State Ss. 409, 468, 471 & 477-a---Criminal breach of trust, forgery for the purpose of cheating, using as genuine a forged document, falsification of accounts---appreciation of evidence---Documentary evidence insufficient for conviction---Prosecution case was that the accused fraudulently and dishonesty defrauded and caused financial loss to the bank amounting to Rs. 19,09,000/----Case of the prosecution was based on oral as well as documentary evidence and the oral evidence had already been disbelieved against the accused therefore there remained only documentary evidence in the shape of counterfoils and the receipts showing the amount was deposited and the bills were paid in the bank---Prosecution had not produced convincing evidence to prove that at the relevant time the accused was posted as a cashier---Documents relied upon by the prosecution against the accused were never sent for seeking expert opinion in respect to confirming the signature of the accused on it nor the prosecution produced any document to prove that the accused was posted as a cashier at the bank at the relevant time---Thus the documentary evidence so produced by the prosecution was not sufficient to maintain the conviction of the accused---Circumstances established that the prosecution had failed to prove its case against the accused beyond any reasonable doubt---appeal against conviction was accordingly allowed.
