ARSHAD ALI VS State S. 302(b)--- Qatl-i-amd---Appreciation of evidence---Benefit of doubt---Motive not proved---Accused was charged for committing murder of the brother of the complainant by firing---Motive for the offence was stated to be a dispute over the landed property---So far as motive was concerned, it was always considered a double-edged weapon which cut both sides---Motive could be a reason for involvement of an accused and the same could be a reason for false implication of an accused---In the present case, although motive was stated to be a dispute over landed property, but the evidence in that respect was deficient, therefore, same could not be taken into consideration---Circumstances established that the prosecution had failed to prove its case beyond shadow of doubt---Appeal against conviction was accordingly allowed.
