Syed RAHEEM VS MUHAMMAD KAREEM S. 135----Constitution of Pakistan, Art. 199---Partition proceedings before Revenue Authority--- Factual controversy---Constitutional jurisdiction of High Court---Scope---Petitioners/share-holders invoked constitutional jurisdiction of the High Court against order of the Member Board of Revenue reversing the orders passed by Revenue Officers on an application for partition of joint property---Held, that the petitioners had not arrayed the Provincial Government, Revenue Officials and most particularly, the Member of the Board of Revenue whose order had been called into question---Impugned order was a remand order which was not open to judicial review under constitutional jurisdiction---Moreover, it was abundantly clear that factual controversy was involved which, too, was not amenable to judicial review under constitutional jurisdiction of High Court---Petition being bereft of merits was dismissed, in circumstances.
