Yaseen Balouch VS State Ss. 302, 324, 365 & 34---anti-Terrorism act (XXVII of 1997), S. 7---Qatl-i-amd, attempt to commit qatl-i-amd, kidnapping or abducting with intent to secretly and wrongfully confine person, common intention, act of terrorism---appreciation of evidence---Benefit of doubt---Rule of consistency---Co-accused acquitted out the same set of evidence---accused were charged for committing murder of sister, brother-in-law and two nephews of the complainant, injuring his niece and also committing rape with his niece and her mother---Record showed that the court had already acquitted minor co-accused persons of the murder of the deceased and injury to injured witness, who had the same role as the accused in the murders based on the same evidence before the court---In such circumstances the court could not convict the accused for the murder of the deceased and the injury to injured Witness---accused was acquitted based on the benefit of doubt which was also extended to co-accused persons by the court---appeal against conviction was allowed, in circumstances.
