Mumtaz VS State Ss. 365-a, 148 & 149---anti-Terrorism act (XXVII of 1997), S. 7---Kidnapping or abduction for extorting property, valuable security, etc., rioting armed with deadly weapon, unlawful assembly, act of terrorism---appreciation of evidence---Benefit of doubt---No medical evidence available---Effect---accused was charged that he along with his co-accused persons kidnapped many persons on the force of weapons and demanded ransom of Rs. ten lac for their release---Record showed that there was no medical evidence or ocular evidence to prove that after a period of 25 to 27 days in the captivity of the abductors living rough in a tent that the alleged abductees had been maltreated e.g. through beatings or that they had even lost weight due to a lack of food which might be expected in such type of cases---appeal against conviction was allowed, in circumstances.
