MUHAMMAD JUMAN VS State. S. 302(b)---Qatl-i-amd---Re-appraisal of evidence---Delay of 9-10 hours in lodging the FIR plausibly explained---Scope---Accused were charged for committing murder of the son of complainant---Record showed that there was a delay of nine to ten hours in lodging the FIR but the complainant had plausibly explained the said delay---In the contents of the FIR, it was mentioned that after arranging transport, the dead body of the son of the complainant was taken to hospital and after getting the postmortem examination conducted, the dead body was handed over to the complainant party who took the said dead body to the village---Complainant further stated therein that after performing the funeral rites, he went to the police station and lodged the FIR---Under the circumstances, the said delay in reporting the matter to the police had been plausibly explained by the prosecution and the same was not fatal to the prosecution case---Circumstances established that the prosecution proved its case against the accused-petitioners beyond any shadow of doubt, however due to mitigating circumstances in the form of non-proving the motive, the death sentence was converted into imprisonment for life---With said modification in sentence, appeal was partly allowed, accordingly.
