SAJJAD alias Kala VS State. Ss.302(b), 324, 148 & 149---Anti-Terrorism Act (XXVII of 1997), Ss.6(1)(m) & 7(a)---Qatl-i-amd, attempt to commit qatl-i-amd, rioting armed with deadly weapons and terrorism. Re-appraisal of evidence---Multiple murder---Assault on police escort---Murder in police custody. Serious violence against law enforcement agencies, even in context of private disputes, may acquire character of terrorism when it systematically targets persons performing functions of rule of law. If harm is caused to an official due to an act performed in discharge of official duty, such act falls within definition of terrorism under Section 6(1)(m) of Anti-Terrorism Act, 1997. Supreme Court set aside conviction under Section 7(a) and altered it to Section 7(1)(h) of Anti-Terrorism Act, 1997. Conviction and sentence under Sections 302(b) and 148 PPC were maintained. Appeal was partly allowed.
