UMER JAN VS State. Ss.302(b), 324 & 34---Qatl-i-amd---Presence of witnesses at spot not proved. Complainant and eyewitness claimed indiscriminate firing by accused persons but remained completely uninjured. Such conduct created serious doubt regarding their presence at scene and truthfulness of their testimony. Witnesses being related to deceased and having motive due to blood feud required cautious examination. Appeal allowed and appellant acquitted.
