MUHAMMAD RAEES VS State. Sections 302(b), 324, 148 & 149, Pakistan Penal Code, 1860---Qatl-i-amd, attempt to commit qatl-i-amd, rioting armed with deadly weapons, unlawful assembly---Reappraisal of evidence---Ocular account---Medical evidence---Reliability of witnesses---Scope. Accused-petitioner was charged that he along with co-accused persons committed murder of his father and two nephews and caused firearm injuries to three persons. Occurrence took place in daylight at 10:00 AM. Crime report was promptly lodged at 11:30 AM. Three innocent persons, including father and nephews of petitioner, were murdered in the occurrence. Prosecution produced three injured persons to establish ocular account. Medical evidence was brought on record through three Medical Officers. Held: Testimonies of witnesses furnishing ocular account were consistent, trustworthy, confidence inspiring and reliable. Ocular account was fully supported by medical evidence. Petitioner was arrested on the same day of occurrence i.e. 11.03.2015 and firearm weapon was recovered from his possession. Forensic Science Laboratory Report was positive. Prosecution successfully proved guilt of petitioner beyond reasonable doubt. The occurrence was gruesome, shocking and brutal in nature. Due to aggravated circumstances of the offence, sentence of death awarded by Trial Court and confirmed by High Court was justified. No reason existed to interfere with well-reasoned judgment of High Court. Petition for leave to appeal was dismissed and leave was refused.
