SANOOBER KHAN VS State. Sections 302(b) & 338-E, Pakistan Penal Code, 1860---Criminal Procedure Code (V of 1898), Section 345---Qatl-i-amd---Compounding of offence---Legal heirs resiling from their statements---Effect. Accused was convicted by the Trial Court and sentenced to death. Legal heirs of deceased made statements before the Trial Court regarding compounding of offence but subsequently resiled from their statements. Held: Legal heirs did not challenge before the High Court the statements of compromise recorded by the Trial Court. Once statements were made before the Trial Court, the matter had attained finality and legal heirs could not retract their statements subsequently. Accused had remained approximately 10½ years in death cell. All legal heirs of deceased submitted affidavits before Trial Court and testified that they had forgiven accused in the name of Almighty Allah without receiving any compensation and that they had no objection to acquittal of accused. Supreme Court altered the sentence awarded by the Courts below from death sentence to imprisonment for life. Application under Section 338-E, P.P.C. read with Section 345, Cr.P.C. was partly allowed because death sentence could not be upheld. Appeal was partly allowed.
