MUHAMMAD AMJAD VS State. Ss.302(b), 148 & 149---Qatl-i-amd---Co-accused acquitted on same set of evidence. Prosecution case mainly rested upon ocular testimony of complainant and witness who claimed to have witnessed occurrence. Both witnesses assigned firing role to five accused persons including appellant. Trial Court acquitted co-accused persons after finding ocular account unreliable. Same evidence was relied upon for conviction of appellant without pointing out any distinguishing feature. Evidence was indivisible and incapable of separate appreciation against appellant. When prosecution evidence is disbelieved regarding co-accused and same evidence cannot be separated, conviction of remaining accused cannot be maintained. Prosecution failed to prove guilt beyond reasonable doubt. Appeal was allowed.
