SHAHID IQBAL VS State. Ss. 302(b), 302(c) & 34---Qatl-i-amd, common intention---Re-appraisal of evidence---Conviction, alteration of---Accused-petitioner was charged that he along with his co-accused persons committed murder of the brother of complainant by firing---Ocular account of the prosecution brought on the record through complainant and an eye-witness to the extent of role attributed to the petitioner of causing firearm injuries to deceased was confidence inspiring and trustworthy and the same had also been supported by the medical evidence produced by the prosecution through Medical Officer---Circumstances established that prosecution had proved its case but due to extenuating circumstances, the conviction and sentence of the petitioner under Section 302(b), P.P.C, was set-aside, however, petitioner was convicted under Section 302(c), P.P.C, and sentenced to 14-years imprisonment---Petition was converted into an appeal and partly allowed, in circumstances.
